1. Acceptance of Terms
By downloading, installing, or using Tolma ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Tolma ("we", "our", "us"). We may update these Terms from time to time, and your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
2. Description of Service
Tolma is a precision fitness tracking application for iOS that provides:
- Workout Tracking: Log exercises, sets, reps, and weights with automatic personal record detection
- Offline-First Architecture: Full functionality without an internet connection, with automatic cloud synchronization when connectivity is available
- Cloud Sync: Secure data synchronization across your devices via Supabase
- Social Features: Activity feeds, leaderboards, and workout sharing with other users
- Workout Templates: Create and reuse structured workout routines
- Progress Insights: Track your fitness journey with detailed analytics and history
We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.
3. Accounts
To use Tolma, you must create an account using Sign in with Apple. By creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your Apple ID and account credentials
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
Each person may maintain only one account. Creating multiple accounts to circumvent restrictions or abuse features is prohibited and may result in account termination.
4. Subscription Terms
Tolma offers a free tier with core features and a premium subscription (Tolma Pro) with advanced capabilities.
4.1 Pricing
- Monthly: $9.99/month
- Annual: $59.99/year
4.2 Free Trial
New subscribers receive a 30-day free trial of Tolma Pro. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
4.3 Billing
- Payment will be charged to your Apple ID account at confirmation of purchase (or at the end of the free trial period)
- Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
4.4 Managing Your Subscription
You can manage and cancel your subscriptions at any time through your device settings:
- Go to Settings → Apple ID → Subscriptions
- Or visit https://apps.apple.com/account/subscriptions
Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
5. User Content
You retain full ownership of all content you create within Tolma, including workout data, exercise logs, templates, goals, and any other user-generated content ("User Content").
By using the App, you grant Tolma a non-exclusive, worldwide, royalty-free license to store, process, synchronize, and display your User Content solely for the purpose of providing and improving the service. This license terminates when you delete your account.
For content you choose to make public (e.g., public workouts, comments, likes), you grant other users a limited license to view and interact with that content through the App's social features.
6. Acceptable Use
You agree not to use Tolma to:
- Harass, bully, or intimidate other users through comments, workout descriptions, or any social feature
- Post spam or unsolicited promotional content
- Share illegal content or use the App for any unlawful purpose
- Impersonate other users or misrepresent your identity
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the App's infrastructure, servers, or networks
- Reverse engineer, decompile, or disassemble the App or its underlying technology
- Use automated tools (bots, scrapers) to access the App or collect data
We reserve the right to remove content and suspend or terminate accounts that violate these guidelines.
7. Intellectual Property
The Tolma name, logo, design system, user interface, source code, and all associated intellectual property are owned by Tolma and are protected by applicable copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or distribute the App or any part of it
- Use the Tolma brand, logo, or trademarks without prior written permission
- Create derivative works based on the App
8. Disclaimer
Tolma is not a medical or health advice service. The App is designed for fitness tracking and progress monitoring purposes only. It does not provide medical diagnoses, treatment recommendations, or health advice.
- Always consult a qualified physician or healthcare provider before starting any new exercise program or making changes to your fitness routine
- If you experience pain, discomfort, or any adverse health effects during exercise, stop immediately and seek medical attention
- The workout data, insights, and recommendations provided by the App are for informational purposes only and should not be relied upon as a substitute for professional medical advice
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAYTOR FITNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data or workout history
- Loss of profits or revenue
- Personal injury resulting from exercise activities
- Interruption of service or inability to access the App
- Any damages arising from third-party services (Apple, Supabase)
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Termination
We may suspend or terminate your account and access to the App at any time, with or without notice, for conduct that we believe:
- Violates these Terms of Service
- Is harmful to other users, third parties, or our business interests
- Involves fraudulent, abusive, or illegal activity
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account and associated data in accordance with our Privacy Policy
- Any active subscription will be cancelled, though no refund will be issued for the remaining period

11. Changes to Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you through:
- An in-app notification highlighting the key changes
- Email notification (if you have provided an email address)
- An updated effective date on this page
Continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you should stop using the App and delete your account.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Georgia. You agree to submit to the personal jurisdiction of such courts.
